City attorney presents code change to clarify civil vs. misdemeanor offenses in traffic chapter

David Hopkinson of the city attorney’s office told the committee the proposed ordinance clarifies the default offense level in Title 10 of the municipal code so provisions that are civil sanctions are not mistakenly read as misdemeanors.
Hopkinson said the change targets Title 10, chapter 4, section 50, which addresses traffic violations and similar matters. "This is really is just a conforming change, to get rid of any ambiguity within that title with respect to what, the punishment actually constitutes, whether it's a misdemeanor or a just a civil infraction," he said, and he cited other sections in Title 10 that reference civil traffic sanctions.
Committee members asked clarifying questions about the distinction between civil sanctions and misdemeanors; no public comment was offered. The committee voted to approve the ordinance as to form on second reading and recommended it for final council action.
