Committee approves substitute to delay park impact-fee reporting, clarifies school exemption

The Cheyenne Public Services Committee on June 16 approved a substitute to an ordinance that changes when the city’s park impact fees are collected and clarifies an exemption for school-district recreational sites.
The substitute, approved by voice vote, does not change fee amounts or how fees are calculated but moves collection from the time of planning approval to the time of building permit. It also clarifies that a school district must have a contract with the city in order for playgrounds or recreational spaces to be exempt from the fee, and it changes the reporting due date to Sept. 30 per the district treasurer’s recommendation.
Seth Lloyd, Planning and Development Department staff, told the committee, “The changes do not change the amounts or the way the fees are calculated. Just changes the timing from time of planning and to time of building permit, with a few other modifications relevant to that.” He also noted staff prepared a substitute after prior committee discussion.
Committee discussion focused on the substitute language and the reporting deadline. The substitute dated 06/05/2025 was adopted and then amended to read September 30 for the reporting deadline; the committee moved the ordinance forward as the recommendation for final approval at the Monday council meeting.
Dr. Aldridge moved approval on third reading and to adopt the 06/05/2025 substitute; Dr. Emmons seconded. Dr. Aldridge later moved the specific amendment to change the reporting date to Sept. 30; that amendment was seconded and approved. The committee voted by voice to recommend final approval.
The substitute also includes a provision requiring a memorandum of understanding or other contract between the city and the school district to maintain public recreational access where the district seeks an exemption. The transcript records that the school district treasurer asked that the reporting date be moved from Aug. 30 to Sept. 30 to allow additional time to comply.
The ordinance will return to the full City Council for final action on Monday night with the committee’s recommendation to approve.
