The Cumberland Town Council on June 16 voted unanimously to authorize the code enforcement officer to enter a consent agreement with the owners of 6 Crossing Brook Road to resolve a 4‑foot setback violation.
Town Manager Sturgis told the council the property owner built a structure that sits 26 feet from the lot line where the zoning requirement is 30 feet. He described the consent agreement as a "fairly mechanical fix" that will be recorded at the registry of deeds and will allow the current transaction to proceed and future owners and mortgage underwriters to rely on the recorded agreement.
Resident Rhonda Small spoke in favor of the agreement and explained the family circumstances prompting urgency. "Senior care, memory care, full time care with medications, is so expensive, and we're running out of time," she said, asking the council to expedite the correction so the family could complete a sale and cover care costs. Council members expressed sympathy and moved to approve the consent agreement; the motion passed unanimously.
Councilors and staff said survey language noting disturbed monuments and pins was typical and that the nearest structure was roughly 300 feet away, limiting any practical harm from the deviation. Once signed and recorded, the agreement will relieve the current owner and future buyers of the setback concern, town staff said.
