The Wilmington Public Safety Committee on June 9 voted to send to the full City Council an ordinance to amend chapter 40 of the city code regarding military leave for uniformed personnel.
Councilman Latoya Johnson (sponsor) and police department presenters described the change as a housekeeping measure to align city policy with federal law and a collective‑bargaining memorandum of understanding. Major Andrea Janvier, who spoke for the department, said the ordinance clarifies the city’s procedures when an officer’s military service exceeds five years.
“This ordinance just gives us an alignment with USERRA, alignment with the MOU, and alignment with city code to do so on those rare occasions that the time away exceeds 5 years,” Major Andrea Janvier said. Major Janvier added that if an officer’s absence under military orders extends beyond five years without maintaining required training, the officer may need to complete an academy before returning to active duty with the department.
The committee moved, seconded and approved sending the ordinance to the full council; the full Wilmington City Council will consider final adoption on June 18. Committee discussion emphasized the ordinance is intended to clarify reemployment and training requirements rather than change benefits.
