The Malden Zoning Board of Appeals approved revised plans June 18 for front stairs at 35 Hazelwood Street after the applicant reduced one step to obtain a 5-foot-2-inch setback from the lot line.
Applicant Jose Urias told the board he "cut one step back" and submitted updated drawings to the building department so the stairs would meet the five-foot-two setback the board had requested at a prior meeting. Nelson, a building-department staff member, said the department had not yet posted the revised drawings to the city's online portal and asked the applicant to ensure the corrected plans are uploaded.
Board members discussed whether the board could vote without the revised set being posted; staff explained that an approval based on the plans shown would require the applicant to supply code-compliant final drawings to the building department and that noncompliance would return the applicant to the board. Several members expressed a preference that building staff review the revised plans but concluded they could approve the plans as presented if they were not more nonconforming than existing conditions.
Commissioner Bilgin moved to approve the petition on the new proposed plans; Commissioner King seconded. The board voted unanimously to grant petition 25-006 with the expectation that the applicant will file the updated drawings with the building department and that staff will review them for code compliance before permit issuance.
