Madison — The city provided updates June 16 on two ongoing legal matters: enforcement of a historic-board ruling about shipping containers at the Lanthyr Winery property, and litigation concerning Moody Park.
City attorney Joe told the board the city has filed a petition to enforce the historic board’s ruling in the Lanthyr Winery containers matter and that the ruling was appealed and then upheld by the court. He said a trial date has been set for October in the enforcement action. “We have a bridal date set on that,” he said; the board clarified the timeline as a trial set in October and said the matter has been pending since October 2022.
On Moody Park, Joe said the owners’ previous attorney withdrew and a new attorney is involved. The court ordered mediation and the city is attempting to schedule a mediation session with agreed mediators; if mediation fails, the city expects a bench trial. Joe described the matters as multi-year disputes and said the city will attempt mediation first in Moody Park before returning to court.
Board members did not take formal action on the two matters during the meeting; the attorney’s remarks were informational updates about litigation status and next steps.
