Milton BZA approves variance for Birmingham Highway property; applicant says addition will keep lot coverage under 20%

On June 17, 2025, the Milton Board of Zoning Appeals approved variance V-25-15159 for a property at 15925 Birmingham Highway, with conditions requiring conformance to the submitted site plan and a foundation survey before vertical construction.
Michael Cardeman, senior planner, said the site is a 1-acre parcel zoned AG-1 in the rural Milton overlay and that the existing house sits 48.4 feet from the front property line under Section 3.14(a) of the Unified Development Code, which references a 60-foot minimum front yard. Cardeman also told the board the proposed addition would connect to the existing home via a breezeway, that the addition meets setback requirements, and that the property’s lot coverage would remain below the 20% maximum—rising from about 9.4% existing to approximately 19.9% with the addition.
Applicant Oscar Pucci Abbey described the plan as a single-story slab addition that ties into the existing house; he said the owner wishes to retain the existing smaller home on site for parents while the new portion is completed. Applicant Krishbimodhi said the expansion would allow the homeowner to move aging parents to the property and requested the board’s approval. The applicant indicated permitting would be sought in mid-July with construction to follow.
The Design Review Board previously reviewed the elevations and recommended approval; staff recommended two conditions: that construction follow the variance site plan from LJA Surveying Inc., received May 12, 2025, and that the applicant provide a foundation survey before vertical construction.
Hodge Patel moved to approve the variance with those two conditions; Adam Danella seconded. Board members cited the age of the existing house (built in 1987, before the city’s incorporation) and neighbor support as factors weighing in favor. The motion passed unanimously.
The board’s approval allows the applicant to pursue permitting and construction subject to the site plan and the foundation-survey requirement.
