PUNTA GORDA, Fla. — At a pre-agenda meeting, Punta Gorda city staff reviewed several upcoming contract awards for water and infrastructure work and answered council questions about termination and penalty clauses in city contracts.
Staff announced an agreement award to Odyssey Manufacturing Co. of Tampa for construction improvements to alum and ammonia systems and sulfur feed systems at the Shell Creek Water Treatment Plant. The council also reviewed an award to the CNCCR division of CRM of Gainesville (authorization number 3) and an agreement award to Olameter Corporation for manual meter-reading services within the city service area. Another agenda item noted an award to Guymon Construction of Cape Coral for replacement of a clay gravity main on Olympia N. 41.
Council members asked whether the city’s standard contracts include penalties or breach/default language to enforce schedules. City procurement staff, Anne Heinem, confirmed the contracts include a 30-day cancellation-for-convenience clause and separate shorter notice provisions for default; staff clarified that a five-day written notice is typically used for default situations. One council member asked whether an early-termination clause without penalty could be included in the Olameter contract given anticipated changes to utility systems; procurement staff said they would “certainly look into it.”
Council members said penalties help keep contractors on schedule unless excused by events such as hurricanes. No formal motions or votes were taken at the pre-agenda meeting; the items were presented for questions ahead of the regular meeting where formal approvals are expected.
The council also briefly discussed the timeline for a scheduled award and indicated that the full fiscal-year 2026 budget status update for sanitation, building and gas-tax funds will be presented at the regular meeting, when council action will be possible.
