Salem Lakes demands Paddock Lake preserve planned Falcon Way–County F through road in Brenner Fields submission

Village staff notified the board that a boundary agreement and cooperative sewer-service plan that affects parcels along Highway 83 will expire Dec. 20, 2026, and that land in the agreement will transfer to the Village of Paddock Lake on Jan. 1, 2027. The administrator told trustees that the Salem Lakes mill rate is 2.9273 while Paddock Lake's mill rate is 4, and warned property owners in the affected area to expect changes in tax bills after the transfer.
Staff raised a separate, immediate concern: a preliminary plat for "Brenner Fields" submitted by Paddock Lake to the Wisconsin DOT included only the northern half of a previously discussed joint development and did not show a through road connecting Falcon Way to County Highway F. Staff noted that the through connection appears in planning documents dating to 2006 and in the 2014 Highway 83 access management plan prepared jointly by Salem Lakes, Paddock Lake, Kenosha County and the DOT.
The administrator recommended that the village insist that the connection be preserved at the time of development or that the right-of-way be guaranteed in a binding legal agreement. "Without a legal agreement securing that connection point before this development moves forward, you would lose the access and through connection that has been discussed and agreed upon for nearly 2 decades," staff said.
Trustees voted to direct staff and village legal counsel to respond to Paddock Lake's request for comment on the Brenner Fields preliminary plat (staff set a June 27 response deadline) and to include objections discussed at the meeting — including a requirement that the through connection be shown or that a binding right-of-way be secured — and to request that the full joint concept be submitted to the DOT so cumulative traffic impacts are considered. The planning commission will see the southern concept at its July meeting for concept review; trustees scheduled a special meeting June 23 to finalize the letter to Paddock Lake before the deadline.
The board's action preserves the village's ability to insist that long-standing access plans be carried forward into new development filings; whether Paddock Lake will accept the demand or resubmit the full project to the DOT was not decided at the meeting.
