Baker council schedules work session on proposed ordinance restricting residential automobile repairs

The City of Baker Council scheduled a work session to review and rewrite Ordinance 2025-6, which would regulate automobile repair work and oil changes in residential areas and subdivisions.

Council members said existing ordinance language is vague and could expose the city to legal challenge if enforcement is attempted. The work session was set for June 3 at 3:30 p.m.

As the council described it: “I’m a private property type of guy. I don't like going on people property telling them what to do, but I am tired of waking up and watching people work on their cars for 4 or 5 weeks when we know that they're just sitting there. And so we need to find the language, together to do that.” The vice president framed the issue as one of clarity: the current ordinance “is all over the place” and “vague, which means if we were to enforce it, technically, we could get sued for damages because a vague law is unconstitutional. So you need to have something that's concise and clear.”

Council members moved and approved a motion to schedule a focused work session so staff and councilmembers can draft clearer language. The council set the session for June 3 at 3:30 p.m.; the motion carried with an affirmative voice vote.

The work session is intended to produce proposed language councilmembers agreed would be sufficiently clear to allow code enforcement to act without exposing the city to vagueness challenges. The council asked members to review existing ordinance text in advance; no new ordinance text was adopted at this meeting. The council did not record any formal legal opinion at the meeting beyond its statement that vague ordinance language presents an enforcement and legal risk.
