Council moves to align town code with state law allowing earlier summer construction hours

The Prescott Valley Town Council read an ordinance by title on June 12 to amend town code noise provisions in response to recently enacted state emergency legislation that changes allowable construction hours.
Town staff explained the new state law restricts municipalities from imposing more restrictive limits on construction hours during a specified summer period. Staff said the change allows construction activities to begin at 5 a.m. on weekdays and permits concrete pours as early as 4 a.m.; Saturday hours will be adjusted to 7 a.m. to 7 p.m., and Sunday hours remain 7 a.m. to 7 p.m. The town attorney and staff said the state legislation is effective immediately and that the town must change its code to conform. Staff noted the six‑month period generally covers the lighter, warmer months and extends through October.
Council voted to read ordinance number 2025‑955 by title on two separate occasions and place it on final passage by unanimous voice vote. The ordinance, as read by the clerk, will be effective 30 days after passage and approval according to law.
