The Boone County Area Plan Commission on May 7 approved the Merrill Minor Plat, a proposed minor residential subdivision that splits a 7.039‑acre agricultural parcel at 5641 West 700 North into three single‑family lots.
Staff told the commission the petitioner, Cross Country Consulting LLC on behalf of property owners Neil and Shannon Merrill and Timothy Sherman and Diana Whiteside, had provided a boundary survey and that the health department found soil borings suitable for in‑ground septic systems. Deborah Luzier, area plan commission director, said technical advisory comments require an outlet for drainage where applicable, first‑floor elevations at least 15 inches above the road centerline, and site‑specific drainage permits for each lot. Luzier said staff recommended approval with conditions including that remaining technical comments be addressed, the Right to Farm law of Indiana be recorded on the plat before building permits are issued, and that an access easement be added if Lots 2 and 3 share a driveway.
The petitioner, Stacy Walt, confirmed the plan and said the new lots would be served by well and septic and that seasonal high water tables meant perimeter drains would not be required. Commissioners discussed drainage easements and a plat note that no basements would be permitted on Lots 2 and 3 without an outlet for sump pumps; staff and the petitioner confirmed the restriction would be noted on the plat.
Commissioner Donnie Lawson moved to approve. A voice vote followed; the chair declared the motion approved. The commission did not record a roll‑call tally in the public remarks captured in the transcript.
The approval is conditioned on the items listed in staff's report being addressed before development proceeds, including the filing of required drainage and driveway permits and recording the Right to Farm notice on the plat. No appeals or remands were recorded during the meeting.
