Council reviews winter rock-salt option-year agreement; members flag 125% purchase clause

Hampton Townships community services staff asked the council to approve an option-year agreement to secure rock salt for the 202526#8211;26 winter season, keeping the townships requested tonnage at 3,500 and noting a price increase for option year one.

"For option year number 1, it's gonna be $88.01 per ton, which is a $3.79 increase from this past season. So we have it on the agenda for your approval of the agreement," said community services staff.

Council members raised a contractual concern: the agreement language states the buyer may be required to purchase additional salt "up to 125% of the commitment" from the COG supplier. Jerry, a council member, and others said that language has been troubling in prior years because the township sometimes purchases salt from state contracts or alternative suppliers when COG suppliers cannot meet requirements. "There is a statement in the contract, which specifies that we will buy all of our salt up to 125% of the commitment, from the COG supplier," Jerry said. He asked that the clause be revisited during next year's negotiations.

Staff and council discussed maintaining multiple supplier agreements to reduce supply risk and noted municipal competition for early deliveries in a season can create shortages. Community services staff said they would ask council to sign the option-year agreement (Morton Salt and Hampton Township) at the next meeting, but that broader discussions about contract language and COG procurement strategies will continue with managers and public works departments.

No formal vote was taken at this meeting; staff will return with the option-year agreement for council approval.
