The Michigan City Board of Zoning Appeals adopted written findings and orders Tuesday that formalize conditions placed on a previously approved use variance for 407 East Eighth Street.
Board Attorney Steven Hale presented the proposed decision and findings of fact for petition B-103-24, noting the public hearing was held May 13 and that the record supports approval with three conditions. "The petitioner shall only be allowed to convert the basement into 1 additional unit, totaling no more than 3 total units for rent," Hale read into the record. The findings also require the petitioner to convert a single-lane driveway into a two-lane driveway and to follow all applicable standards in section 18.02 of the zoning ordinance.
Board member Kathy Stransky moved to adopt the findings of fact for B-103-24; Deborah Vance seconded. The roll call vote was: Ricky Jackson: yes; Fred Clender: yes; Kathy Stransky: yes; Deborah Vance: yes; Brian Gross: yes. The BZA chair then confirmed the documents were available for signature.
Hale told the board the decision and written findings memorialize the board’s prior May action and list the conditions the petitioner must meet as the matter proceeds toward any building permits or inspections.
The adoption makes the conditions an official part of the board record; compliance will be necessary before any work related to unit conversion proceeds.
