At the May 22 special meeting, the City of Eagle Pass planning and zoning commission considered and approved a group of subdivision-variance and final-replat requests that included sidewalk-waiver petitions, lot-size and lot-width reductions, and a pathway for handling sidewalks at the time of development.
Three related items were discussed: a final replat of Lot 2, Block 3 of El Pueblo Nuevo Subdivision (owner Francisco Ballones Jr., applicant Cabell Engineering); a final replat of Lot 8 in Caryville Subdivision (71 Cary Drive, applicant Cabell Engineering); and a final replat of Lot 258 in Loma Bonita Unit 3 (846 Calle Frente, owner Antonio Flores Gutierrez and Maria P. Flores; applicant Cabell Engineering). Each case requested some combination of a sidewalk waiver under section 23-64, lot-size or lot-width reductions under section 23-69, and a waiver to proceed directly to final replat without a preliminary replat under section 23-36.
For the El Pueblo Nuevo replat (Lot 2, Block 3), staff initially recommended denying the sidewalk waiver because it did not meet criteria in section 23-64 (there is existing curb in the area) while recommending approval of the lot-width reduction (reduce average width from 55 to 50 feet) and allowing final replat without preliminary approval. The applicant, Carlos Velarde of Cabell Engineering, asked the commission to consider a plat note committing the owner to construct sidewalks at time of development rather than requiring sidewalks before building permits are issued. After back-and-forth with staff about enforcement and coordination with Maverick County, the commission approved the subdivision variances and added a plat-note condition that sidewalks for both lots be completed at time of development, with coordination with the county as needed.
On the Caryville replat (71 Cary Drive), staff recommended and the commission approved a sidewalk waiver and a waiver to proceed directly to final replat; staff noted no existing curb or gutter in that location and six letters in favor were on file.
For the Loma Bonita Unit 3 replat (846 Calle Frente), staff recommended denying the sidewalk waiver because existing curb and gutter were present but recommended granting lot-area and lot-width reductions and the waiver to proceed to final replat; the applicant asked for a plat note similar to earlier items stating sidewalks would be constructed when building occurs. Staff confirmed that one lot already had an approved building permit and that the owner intended to build sidewalks at that time; the commission approved the variances with the plat-note condition.
Across these items the commission balanced subdivision-code criteria, existing street infrastructure, and practical enforcement by coordinating plat notes with county requirements. Where existing structures made pre-construction sidewalk enforcement more complicated, the commission required a plat note and coordination rather than an immediate sidewalk-installation requirement before final plat recordation.
The transcript shows staff sent 75 notices for the El Pueblo Nuevo item (five undeliverable) and that 31 notices were mailed for Caryville (six letters in favor, zero opposed). For Loma Bonita staff sent 77 notices (no letters in favor or opposition; five undeliverable). The commission’s motions to approve, with the plat-note condition where discussed, were recorded in the public transcript and the commission proceeded to the next agenda items after each motion.
