Fence variance: Timothy Williams, who identified himself as living at 2881 West Edge Boulevard, asked for a variance to replace an existing 5‑foot chain‑link fence with a 6‑foot cedar privacy fence on a corner lot at the Pine Road/West Edge Boulevard intersection. Williams said the house, built in 1969, sits about 16 feet from the Pine Road property line and that the shorter setback on the Pine Road side left the existing fence exposing the yard to the street. He told the council, "without a variance, the side of the fence closest to Pine Road would have to be 4 feet, which doesn't give any privacy." After questions from council members and confirmation that the Planning Commission had unanimously recommended approval, the council voted to approve the variance.
Pike Road permit (item E): Council members probed whether the city should issue permits before applicants have obtained approvals from the watershed district, DNR or other state agencies. City staff and a planner explained that the usual practice is to include permit conditions: applicants must pursue and demonstrate that they have any external approvals required by agencies such as the Minnesota Department of Natural Resources (DNR) or the Minnehaha Creek Watershed District (MCWD), and failure to secure those approvals can result in revocation of the city's permit. As staff described it, "we issue them with conditions to say, basically, if you can't get these approvals ... then they no longer have permission to operate under the permit that we've issued." After discussion the council approved the item with the standard conditional language.
Other consent items: The council approved the remainder of the consent agenda — including liquor licenses, event permits and a lawful gambling premises permit added for Mount West Tonka Hockey Association at Carboni’s Pizzeria & Bar & Grill — by roll call: Council member Eric, Council member McEnany, Council member Pugh and Acting Mayor Castellano voted "aye." The council later approved the two pulled items separately.
