Winter Brothers Waste Systems appeared before the Town of Babylon Zoning Board of Appeals seeking renewal of a special-exception permit to operate a transfer station in West Babylon. The company asked for a five-year renewal of an existing permit originally approved in 1999 and renewed multiple times since.
Attorney Matthew DeLuca told the board that operations have not changed and no site modifications are proposed. He acknowledged there are open items listed in the fire marshal’s report and said Winter Brothers would address the outstanding violations. The fire marshal’s report (on file) and the planning memo were discussed by the board.
Board members said the renewal should be conditioned on the company satisfying the fire marshal’s report and closing any outstanding violations before the renewal is finalized. The applicant’s representative and the board agreed to that requirement. A motion was made to approve application 25-077 for five years conditioned on compliance with the fire marshal’s report and correction of open violations; the motion passed by voice vote.
The board’s action continues the permit-review process and places the responsibility for corrective actions on the operator before finalization and permit issuance. The applicant will be notified in writing of the board’s conditions and any follow-up items that must be completed prior to permit renewal.
