Planning commission denies holdover for resubdivision at 5808 U.S. Highway 90 West after missing owner authorization

On June 12, 2025, the Mobile City Planning Commission voted to deny the resubdivision and modification application for 5808 U.S. Highway 90 West after the applicant did not provide owner authorization and requested a second holdover. Chair Jay Stubbs presided over the vote, which passed after a motion to deny the application.

The application was listed as a holdover from a prior meeting. Applicant representative Jake Mosley told the commission he had been asked to appear and that the county — which he believed to be the owner — had not provided a signature. “As far as I know, I don't know if they contacted anybody. They just had me come here, told me it's gonna be a holdover,” Mosley said.

Staff and legal counsel reminded the commission that the city’s subdivision regulations permit only one holdover request without requiring a new submission and fee. A staff speaker cited Article 10 of the subdivision regulations, noting that any additional holdover would require the applicant to file a new application and pay applicable fees.

After hearing the applicant and staff, a commissioner moved to deny the application; the motion carried. The denial disposes of the pending application as presented at the meeting. The commission noted that the applicant may refile as a new application if the owner authorization cannot be obtained in time.

The denial was procedural and tied directly to missing owner authorization and the limit on repeated holdovers in the subdivision regulations. No separate substantive hearing or findings on the merits of the resubdivision occurred at this meeting.

The commission will not consider further action on this application unless and until the applicant submits a new, complete application that complies with Article 10 and includes owner authorization.
