The Montgomery City Planning Board granted a variance and special exception allowing an accessory structure with sanitary facilities in the required side yard at 3261 Thomas Avenue, subject to conditions including a prohibition on rental use and requirements to retain stormwater on site.
Teddi Berry, the property owner, asked to build an accessory structure adjacent to an existing pool to provide restrooms and a small cooking area closer to the pool. Berry said the structure would serve primarily as storage and would not be taller than the main house; she estimated the peak height at about 20 feet and said the structure would be roughly 8 feet from the property fence at its closest corner.
Board members questioned the structure’s proximity to the street and its visibility because the lot elevation is higher than the adjacent road. The board required that the accessory structure not be available for rent and instructed the owner to retain stormwater on-site (gutters/retention) to avoid runoff toward Glen Groton. The applicant agreed to the no-rental condition.
After the board’s questions about height, visibility and drainage, a motion to approve carried. Staff said it will send the applicant a written approval and the applicant may then apply for permits.
