Applicant representatives (Ronaldo Borges, project architect, and counsel Emily Balter) emphasized the home’s LEED‑Gold strategy, a 35,000‑gallon cistern for site stormwater collection, and equipment siting choices intended to improve resiliency and long‑term maintenance. They argued the air‑conditioning request was intended not to create living space but to avoid mold and humidity damage to high‑value electrical and filtration equipment; the concrete‑slab request was driven by performance concerns adjacent to piled pool structures and large paved terraces; and the louvered trellis was proposed as a durable, low‑maintenance alternative to canvas that will be open most of the time.
Board members expressed concerns about precedent and the code’s original intent: understory spaces are mostly required to be pervious so they can accommodate floodwater and avoid being enclosed into habitable space. Several board members said they could not approve all four items on the record presented and that the panel lacked sufficient technical documentation on long‑term performance and the specific dimensions and location of equipment. The board voted to approve the variance that allows taller screened battery/generator equipment at the side yard (finding it reasonable given the resiliency/battery need and extensive landscaping and screening), but continued the other three variance requests to the board’s next available hearing so the applicant can bring additional engineering and specification details, and to allow the full board to consider the requests (a five‑vote threshold applies to certain variances).
