Nelson County board approves lease financing for social services building

The Nelson County Board of Supervisors voted June 10 to approve Resolution R2025-40, authorizing lease financing through the Virginia Resources Authority (VRA) to fund capital work on the county's Department of Social Services building.
County bond counsel Paul Jacobson of Sands Anderson told the board the resolution authorizes the financing documents and sets a maximum principal amount of $9,450,000, with expected proceeds requested at $9,000,000. Jacobson said the VRA planned to lock interest rates in July and tentatively close the financing on Aug. 5; he added that preliminary figures “came out about 4.3, 4.4% in that range.”
The resolution approves a lease-to-VRA and leaseback financing structure, authorizes county representatives to sign closing documents, and describes the financing as “subject to appropriation,” meaning annual appropriations would be required while the lease remains outstanding. Jacobson said interim financing already used by the county would be paid from the proceeds at closing.
Supervisor Hamilton moved the resolution; the motion passed on a roll-call vote with Dr. Ligon, Supervisor Parr, Supervisor Rutherford and Chairman Reid voting yes. No no-votes or abstentions were recorded in the audio of the roll call.
Board members asked about the timing and risks if bids for related construction are higher than expected; Jacobson and staff said bids would be received before any funds are drawn, and the county could stop the financing if bids exceeded the available financing. Jacobson noted certain federal tax-exempt-bond rules limit private use of financed property and that VRA’s pooled bond process and reporting (including deposit of proceeds to the state SNAP program) would apply.
The board’s approval allows county staff and counsel to complete the documents required by the VRA so the locality can participate in the pooled bond sale. The board did not take additional actions on related construction contracts at the June 10 meeting.
