The Claiborne County Board of Supervisors approved a motion authorizing the board president to sign a letter and a contract of sale for property on Bridal Lane (addresses cited as 1508 through 1596) and asked the county attorney to prepare related documents to memorialize the transaction.
Sheriff's representative and Supervisor Olens (speaker identified as moving the item) introduced a draft letter and purchase agreement and asked the board to add the item to the agenda and vote. County Attorney Tom Stingley reviewed the legal posture: the seller indicated a lienholder would accept a payment and release its lien upon receipt of the agreed funds, which would make the property “free and clear,” but Stingley said he had not performed a title search and normally uses a title search company. He recommended the board approve the president to sign the letter, approve the contract of sale, have the attorney draft a resolution to be added to the minutes, and approve filing a warranty deed after closing.
Stingley also cited Mississippi Code section 43-37-3 (as referenced during the meeting) to note the requirement to notify a seller of just compensation once the board determines it. He said the board could approve the documents with the condition that the paperwork be reviewed and that the attorney’s opinion be included in the motion. Several supervisors expressed concern about not having reviewed the draft letter in advance; the board agreed to approve the motion subject to internal review and Stingley’s input. The motion carried.
