The clerk and recorder’s office told the board the Agilis equipment was purchased in 2020 and that the proposed contract covers both a software subscription and original-equipment-manufacturer maintenance from 2025 through 2029. The clerk’s office relied on Weld County Code section 5-4-80 — the county’s “expenditures not requiring a procurement process” provision — to justify a direct purchase from the proprietary vendor and for original equipment manufacturer maintenance services.
Under the contract the county will pay $75,000 for 2025; $77,250 for 2026; $79,568 for 2027; $81,955 for 2028; and $84,413 for 2029. The board moved to approve the resolution and the measure passed unanimously after the aye/nay call.
The clerk and recorder’s presentation framed the contract as necessary to keep the Agilis hardware and its automatic signature recognition software operational; the board did not request additional motion language or direct staff to solicit alternative vendors during the meeting. The contract was presented and approved as submitted.
The county cited two specific items in Weld County Code section 5-4-80 to support the procurement: item 28 (proprietary software exemptions) and item 29 (original-equipment-manufacturer exemptions for leased, warrantied, or maintained equipment). The contract binds the county to the stated annual fees for the five-year term unless changed by later board action.
Next steps: the chair was authorized to sign the agreement on the county's behalf and the clerk’s office will proceed with the subscription and maintenance relationship through 2029 as approved.
