Weld County adopts code change to permit agricultural land leveling and reservoir dredging

Weld County commissioners on May 19 approved code changes adding an agricultural land-leveling and agricultural-reservoir-dredging permit to Chapter 8 of the county code and exempting permitted activities from certain grading permits.
Planning Services presented the ordinance as a codification of an intergovernmental agreement with the State of Colorado Division of Reclamation, Mining and Safety (DRMS). The ordinance adds six sections to a reserved Article 10 of Chapter 8 (purpose and intent; definitions; permit issuance criteria; application and limitations; administrative fee; appeals), and clarifies an exemption to the county’s grading-permit rules.
Dawn Anderson of the Department of Planning Services said the proposed fee for the new permit would be $100 and that permits are issued for a single agricultural year, with annual renewals available to document progress on larger projects such as reservoir work.
Commissioner Kevin Ross thanked staff and Senator Byron Pelton for assistance in negotiating the intergovernmental agreement. Commissioner Scott James asked whether the IGA is perpetual; staff confirmed the ordinance codifies the county's method for permitting under the IGA rather than creating an indefinite IGA.
No members of the public spoke during the public hearing. Commissioners Ross and James moved and seconded approval, and the reading was approved on voice vote.
