Vice Mayor Jan DeBoskis asked the council to direct the city attorney to draft an ordinance prohibiting smoking within 50 feet of city playgrounds.
"It came to my attention that we've had an issue with smoking near playgrounds," DeBoskis said during the mayor-and-council items portion of the meeting. "I was actually really surprised that we don't have an ordinance that prevents smoking near our playgrounds."
DeBoskis moved to direct the city attorney to prepare draft language for possible changes to Chapter 19 of the Scottsdale Revised Code to prohibit smoking within 50 feet of a city playground and to have the responsible charter officer agendize the item for a future council meeting. The council voted in favor of the direction and staff will return with draft ordinance language and any necessary legal analysis.
At the dais, one council member asked whether state smoke-free statutes might already address the proposal; the city attorney and staff indicated they would research relevant state law (for example, smoke-free Arizona provisions) and advise whether a municipal ordinance is necessary or how it would be coordinated with state law. No final ordinance was adopted; the item was referred to the city attorney for drafting and legal review.
