Polk County commissioners on June 10 reviewed guidance from the Texas Association of Counties about restricting the sale or use of restricted fireworks during periods of drought and approved a motion that will bar certain aerial fireworks and allow county officials to stop broader fireworks sales if drought conditions are formally declared.
County staff told the court that Texas Association of Counties guidance requires any order prohibiting or restricting sale or use of restricted fireworks (identified by staff as aerial devices such as skyrockets) to be adopted before June 15 if the county is in a designated drought area. The court discussed limiting restrictions to those typically regulated as restricted fireworks and leaving sales of other fireworks permitted unless drought conditions change.
Commissioner Robertson moved the motion and Commissioner Dubose seconded. The court voted in favor. Staff said the fire marshal and local fire departments are monitoring the drought index and would notify the court if conditions change so that additional restrictions could be adopted.
