The Rutherford County Board of Zoning Appeals approved a special-exception request allowing a noncommercial storage building at 11078 Patterson Road, subject to conditions including submission of soils verification and building inspection to bring the structure to code.
Staff said the 8.4-acre property contains an approximately 3,472-square-foot (approximately 62-by-56-foot) building that was erected without a building permit and was identified through an electrical inspection. The applicant, Mike Donovan, told the board the structure contains no living facilities and is used for personal storage for his vehicles and hobby; he said he had contacted the previous owner and a soils group about locating any past soil-percolation documentation but that obtaining a fresh soils test could take months.
Code enforcement noted prior inspections and that an RV had been on site; staff recommended conditions limiting outdoor storage, requiring the applicant to bring the building up to code, submit soil-science verification that the site does not perk for septic (or comply with septic requirements), and to shelter the RV or store it inside the building. Board member Amber Brown moved to approve subject to those conditions; the motion carried on roll call. The board also adopted an amendment that if the site does not perk, a porta-potty must be provided on-site until appropriate septic verification or infrastructure is in place.
