Residents ask city to investigate missing rear fencing in townhome development

Two Santaquin residents told the City Planning Commission on Tuesday that a required rear-yard fence at their townhome development was not installed and that recent backyard disputes might have been prevented if the fence had been in place.
The residents said they live at addresses on East 990 North and cited what they described as a 2019 fence requirement. They asked the commission to direct staff to review the development plan and confirm who is responsible for installing the fence.
Nathan Haines, a resident at 144 East 990 North, told commissioners he and neighbors “would like to report a possible noncompliance with ordinance 808012019, fencing and multifamily developments.” Haines said his development was finished in 2020 and that some nearby developments do have fences while others do not. He provided photos and a packet to staff as part of the record.
Paige Aguirre, who said she lives two houses from Haines, described ongoing safety concerns affecting children and said the absence of a fence has made outdoor play unsafe: “It has been ongoing for 5 years and I don't think there will be any resolution outside of if we can just seek protection from, you know, offense.”
Commissioners noted that code enforcement and compliance investigations are handled by city staff rather than the commission. Jason Bond, community development staff, said staff would take the packet, review the materials and “we'll look into the situation and see what happened there, and we'll just be in touch with you.” Bond also gave the residents office-hours and contact guidance for follow-up.
No formal enforcement action was taken at the meeting; the commission closed public forum and moved on to the night's agenda. The residents left materials with staff for the department record.
