The Oshkosh Common Council voted 6-1 Tuesday to approve Resolution 25-305, a settlement with Walmart that refunds $41,485.28 for property tax assessments on the store at 351 South Washburn Street for tax years 2024 and 2025.
Council member Larson said he would vote no, calling the settlement "a hard pill to swallow" and arguing that it feels inequitable for other taxpayers when large commercial entities use legal avenues to recover assessed taxes. "I have a really hard time with that," Larson said during the meeting.
Council member Nichols and other supporters said litigation expense and the practical cost of defending the case drove the recommendation to settle. Nichols noted that the total dollar amount listed on the agenda is about $41,000 but that the actual cost to the City of Oshkosh is smaller: "The real number, the cost to the people of Oshkosh is $17,000," Nichols said, explaining multiple taxing jurisdictions mean some refunded dollars will come from other bodies.
After discussion about legal costs and precedent, the council approved the settlement on a 6-1 roll call. The motion directs staff to execute the settlement payment and close the matter for the listed tax years; no further litigation on these years was recorded in the meeting.
The settlement drew expressions of frustration from council members who said large taxpayers sometimes pursue different assessment-remedy paths than smaller property owners; city staff and the city attorney had briefed council prior to the vote, according to remarks during the meeting.
