District counsel says commissioners generally lack authority to remove appointed trustees; board authorizes response

District legal counsel told the Super District the board that, in counsel's opinion, "Indiana law is quite settled on this" and that trustees appointed for a stated term generally can be removed only for cause. The remarks followed correspondence from the Marshall County commissioners questioning trustee appointments.
Counsel recommended the district prepare a succinct factual history and a legal response. The board moved, seconded and approved a motion authorizing counsel to draft and send that response, subject to review and approval by the district officers before transmission. The motion passed by voice vote; the transcript records "Aye" from the board but does not record individual tallies.
Counsel said a brief historical summary of the district (pre-formation actions through the December 2022 formation order) is being drafted and will be circulated to trustees for comment before finalization. The board indicated the draft response will be finalized by the officers and transmitted before the commissioners' next meeting date discussed in the packet.
Ending: the board approved the authorization and asked counsel to circulate the draft response to the officers for review. The board then moved into an executive session as indicated on the agenda.
