Special Magistrate Erica Augello continued the City of St. Pete Beach code enforcement status hearing for the property owned by the Richard Allen Long revocable trust after learning the permit application remains under city review.
Ayaka Shell and a city building official appeared for the city. The building official told the magistrate the permit had been submitted but “has not been reviewed yet,” and the review had not reached a determination on approvability.
The respondent, who identified himself at the hearing, said he had submitted revisions and that the back patio remained closed pending permit approval. He described business impacts but did not request immediate relief from the magistrate.
Augello said she would not impose fines while the city’s review was outstanding. “At this point, I am not going to impose any fines or any fees... the respondent did submit in the revisions as per my order,” she told the parties, and set the matter for a status check on July 14, 2025.
The magistrate directed that a written order be issued and emailed to the respondent and the property owner once drafted. The order will reflect that the city bears the burden of proof in the matter and that the permit review remains pending.
