Commission approves changes to solid‑waste definitions to match Virginia code

The Fluvanna County Planning Commission on June 10 voted 5‑0 to recommend a zoning‑text amendment that revises local definitions for solid‑waste facilities to align with the Code of Virginia.

Staff said the amended text will add a definition for “solid waste” that references the Code of Virginia (section 10.1‑1400) and will redefine “solid waste material recovery facility” and “solid waste collection facility” to reflect state terminology and to clarify that collection facilities are relay points where no processing occurs onsite.

The revised language also adds the standard condition that facilities “shall be so located, designed, and operated that they do not pose a substantial present or potential hazard to public health or the environment, including pollution of air, land, surface water, or ground water,” language staff said was added following commission direction and research into other counties’ definitions.

At the public hearing, a resident urged limiting the geographic origin of solid waste entering the county to avoid becoming a regional disposal hub; staff and commissioners acknowledged enforcement limits but said language tied to the Code of Virginia provides regulatory guardrails.

The commission moved the amendment forward with a recommendation to the Board of Supervisors; staff will prepare the ordinance and referral materials for the board public hearing.
