Board approves variance for pole building after septic test condition

The Marshall County Board of Zoning Appeals on June 10 approved a variance allowing construction of a pole building on a parcel zoned R‑3, with a condition related to septic siting.
Nicholas, the county planner presenting the case, told the board that staff recommended approval of the variance but that the Technical Review Committee (TRC) recommended an approval condition requiring soils to be tested and a layout for a future septic site before final approval.
Applicant Dana Kenny confirmed to the board that a perk (percolation) test had been completed May 29 and that the Marshall County Health Department has the paperwork. Kenny described the building as a maintenance/equipment structure for properties the applicant owns and said the planned building would avoid interfering with any future septic area.
The board opened and closed the public hearing with no speakers for or against. After discussion, a motion to approve the variance passed; the record shows the board adopted the staff findings of fact on public health, safety, welfare, use and value, and practical difficulty. The motion to approve was made and carried with affirmative votes recorded and no conditions beyond the TRC requirement noted in the staff recommendation.
The board instructed that any septic permitting or additional septic work will require review and approval by the Health Department as required by county practice.
