Members of the Town of Needham’s Stormwater Bylaw Working Group spent much of their June 9 meeting debating which local body should have authority to adopt regulations that implement a proposed stormwater bylaw. Participants discussed whether the Select Board’s oversight would provide a transparent public check, or whether delegating rulemaking to DPW or an engineering official would allow faster, more technical updates.
The debate centered on two competing goals: making regulations accessible to the public through a Select Board process and keeping regulations nimble so staff can respond to changing law, EPA expectations and technical requirements. One working group member said the Select Board could adopt regulations so they would not require a town meeting every time they were revised, while others argued that DPW or the town engineer would typically draft changes and present them to the Select Board for review.
Legal questions about formal authority surfaced in the discussion. Participants noted the bylaw itself will need to be adopted at Town Meeting, but that regulations intended to implement the bylaw can be delegated to another body. The group agreed that regulations should be able to change more quickly than a bylaw so the town can respond to changing state and federal expectations without waiting for a Town Meeting cycle.
Several members requested wording changes in the draft to replace legacy phrasing (for example, changing “selectmen” to “Select Board”) and to clarify that engineering or DPW would prepare recommended regulatory changes for formal adoption. The working group signaled support for drafting language that makes clear: (1) the bylaw is adopted by Town Meeting, (2) regulations implementing the bylaw are adopted by the Select Board, and (3) DPW or engineering staff will prepare and present those regulations for adoption.
The group asked staff to update the draft to reflect that approach and to bring the revised language back for review at a future meeting.
