Peter Kelton, counsel on the matter, said the Foxtail Flats IRB aggregate capacity would increase by $12 million to $374 million and the 4 Mile Mesa projects would increase to a maximum aggregate capacity of $459 million. Kelton said the amendments also ratify that county staff mailed the statutorily required notices to the county’s taxing jurisdictions in May and that the county will publish a summary notice in the Tri‑City Record ahead of ordinance consideration.
Mike Stark, San Juan County manager, said county staff and bond counsel have been working with the developer’s counsel and that the increases reflect the projects’ advancing plans; he told commissioners that negotiations over pilot payments to local taxing entities, including San Juan College and local school districts, are ongoing.
Nate Runyon of Holland & Hart, counsel for the projects, and Winter Swanson of developer DESRI (Desiree) thanked county staff and commissioners and said they are finalizing terms and a power‑purchase agreement for the 4 Mile Mesa project.
The commission voted in two separate motions — one for each inducement resolution — with both motions carried (voice votes recorded as "aye"). The county and project representatives said they expect ordinances authorizing the IRBs to be brought back for formal adoption at the July 1 commission meeting, pending publication and the statutory notice period.
