What owners told the commission: Property owners said docks are free-floating or rest on movable supports and are removed or stored seasonally. George Leconte of 163 North Lake Ave said the stairs and small fixed elements have been present for decades but the docks are “free floating” and sit on barrels. Nancy Loconti and Bob Kushwas similarly described aluminum or small docks that are brought ashore each winter. Owners said no permanent ground disturbance was made to place the docks.
Staff recommendation and conditions: City staff said they were bringing several existing docks into compliance and recommended identical conditions for each negative determination: (1) note of Commonwealth requirement for a Chapter 91 license where applicable; (2) seasonal storage of docks to avoid damage to other properties; (3) no fuel storage within 100 feet of the wetland; (4) any future alterations would require separate permits. Staff said stipulations would be communicated in the determination documents and by email.
Commission action: Commissioners moved to issue negative determinations for the Lake Avenue North items and recorded affirmative votes for the motions. The determinations were limited to continued seasonal use of existing structures; any alterations or new permanent work were not covered and would require additional review.
What to watch: Owners must comply with the conditions including seasonal storage and state licensing requirements where applicable; staff will notify homeowners in writing when determinations are issued.
