Park County commissioners approved a resolution granting a conditional-use permit (CUP) for an existing residence and construction of a new garage on a 6.09-acre parcel in the Mining Zone District addressed as 1109 County Road 14, Fairplay.
County staff reported the house was built in 1979, the parcel has not shown evidence of geological hazards, and the Mining Zone designation in that area dates back to 1975 as a legacy zoning category. The permit process required a geologic survey and the staff report concluded there was no evidence of geologic activity on the parcel.
Commissioners noted the Mining Zone designation covers many properties in the Plain area and said this approval addresses a conformance issue so the owner can add a garage. No opponents were recorded in the meeting minutes; the staff report recommended approval and the board approved the resolution 3–0.
Commissioners characterized the CUP as a formal recognition of long-standing residential use on a parcel that remained in the Mining Zone by historical zoning practice. The action adopts the staff findings and allows the property owner to move forward with the garage construction under conditions reflected in the staff report.
