City Manager Michael Scraig explained the ordinance formalizes work that has been conducted by an attorney identified in the discussion as Adam, who has served as interim counsel after a prior attorney resigned in December. Scraig told the council Adam also currently provides counsel for several neighboring municipalities and that the proposed agreement spells out duties, reasonable fees and procedures for rate changes or termination. He noted city code distinguishes the city attorney/city counselor roles and that the code assigns appointment authority to the mayor and council for those officers.
The council approved a motion to read the ordinance by title only and then voted to adopt the ordinance. Roll-call votes were recorded as Kushner: yes; Osborne: yes; Lothari: yes; Euler: yes. The ordinance passed.
City staff characterized the agreement as standard and noted it preserves the council’s ability to direct the city counselor on matters that, in some cases, the council prefers remain responsive to elected officials rather than the city manager.
There were no amendments to the ordinance during the meeting and no further direction beyond signing authority and final execution.
