Planning Commission approves rezone and preliminary plat for Old Hill City Road lots after acreage, floodplain questions

The Pennington County Planning Commission on June 9 approved a request to rezone two adjoining Old Hill City Road parcels from agriculture to rural residential and accepted a preliminary plat to combine the lots.
Staff, represented by Senior Planner Cody Sackett, told the commission the request covers two lots at 12494 and 12496 Old Hill City Road and involves about 3.86 acres as currently shown in county documents. The parcels include a floodplain and a floodway and currently carry residential uses under agricultural zoning.
The commission’s discussion centered on the exact acreage and floodplain implications. "I'll confirm with the surveyor on that," Sackett said when a commissioner questioned whether the combined parcel would be about 4.3 acres after dedications. Sackett also explained how floodplain rules apply: "So it just means that any, any modifications or improvements to the, that structure that's over 50%... they have to make sure that that house actually meets base flood elevation." The commissioner who raised the acreage concern said he could not clearly reconcile the survey drawing with the county map and asked staff to resolve the discrepancy prior to the board of commissioners review.
The commission voted to approve the rezone, CORZ25-0007, and separately approved preliminary plan COPPL25-0004 with four conditions. Commissioners noted that right-of-way dedications to Old Hill City Road could reduce the net acreage once surveyor work is finalized and directed staff to confirm acreage and deeded dedications prior to the Board of Commissioners hearing.
No parties spoke in opposition at the hearing. The staff report noted that interdepartmental review produced no objections to the rezone or the preliminary plan, and staff found the request in harmony with surrounding land uses and the county’s future land-use guidance.
The commission’s recommendations will be forwarded to the Pennington County Board of Commissioners, which will make the final decisions at its regular meeting on June 17, 2025.
