The Monroe County Board of Commissioners on June 5 approved a proposed amendment to the Westgate on Third planned unit development (PUD) phasing narrative that gives the planning director discretion to issue conditional land‑use certificates when adverse weather prevents completion of final landscaping, stormwater pond construction or final asphalt.

Planning staff said the PUD contains multiple phases and eight stormwater bioretention ponds; recent heavy spring rains delayed completion of several ponds needed to meet the existing phasing narrative’s checkpoints. Staff described photo evidence showing work in progress and said the petitioner is actively completing ponds as weather allows.

Under the approved change, if weather prevents required final improvements before a phase’s completion, the administrator (the planning director) may issue a conditional land‑use certificate valid for no longer than six months and renewable once at the administrator’s discretion. The county will continue to require stormwater infrastructure to be installed to plan standards before releasing related letters of credit.

Planning staff said the stormwater program supports the amendment. The Plan Commission forwarded the amendment with a favorable 6–0 recommendation, and the Board approved the PUD amendment by roll call vote 3–0. Planning staff said construction is progressing rapidly and that phase‑by‑phase conditional LUCs will be used to allow occupancy while final off‑site or landscape work is completed.
