Board approves Smith Station Crossing rezoning with proffers to fund intersection work

The Spotsylvania County Board of Supervisors voted to approve R22-0005, the Smith Station Crossing rezoning, rezoning roughly 58 acres to a planned development housing district to allow 99 single-family detached homes after the applicant revised proffers to address transportation concerns.
Kimberly, speaking for county planning staff, summarized the applicant revisions: construction deliveries will be scheduled outside school peak drop-off and pickup periods; the transportation improvement contribution was increased from $1,000,000 to $1,100,000; and the applicant agreed to lengthen the existing eastbound left-turn lane on Courthouse Road (Route 208) toward Smith Station by 200 feet. Staff also said the proffers were amended to require those transportation improvements to be completed prior to issuance of the 40th certificate of occupancy rather than the 60th.
The planning commission had recommended approval on March 19, and staff supported the rezoning with the revised proffers. Supervisors asked about outreach the applicant had made to adjacent property owners. Staff and the applicant reported attempts to contact a property owner whose health issues have delayed further discussion; the proffers were written to give the county discretion to accept an alternative design or a cash contribution if right-of-way acquisition cannot be completed.
Supervisor Dr. Frazier moved approval of the proffers as revised; the motion passed with five yes votes and two no votes. The record shows Ms. Hayes and Mr. Lane voted no.
Staff said the proffers include a school contribution of $2,000 per unit and that program capacity for schools will be maintained under the current plan. The board left the timing and method for any alternative design to county staff discretion if negotiations for additional right-of-way cannot be concluded.
The applicant and county staff remain responsible for coordination on implementation timing, and staff said they would continue efforts to engage the property owner needed for the entrance closure and related right-of-way.
The formal rezoning action concludes the public hearing process and authorizes county staff to enforce the proffer conditions and to accept an alternate design or cash contribution per the proffer language if negotiations fail.
