Community and Economic Development Director Susie Elms told the council the original tentative map was adopted in February 2005 and an earlier development‑agreement amendment was adopted May 6, 2015. The current amendment was set to expire July 15, 2025; the applicant asked to extend it for another 10 years so final maps can be recorded and the remaining single‑family lots completed as market conditions permit. Elms explained a development agreement is a contractual tool that secures development terms and vested rights while allowing phased final maps to record as conditions are met.
In public comment, Tino Gomes (resident and property owner adjacent to Ortigalita Road) said construction activity had damaged landscaping and that traffic and signage on Ortigalita needed enforcement and repair; staff said public works would investigate and follow up. Kathy Ballard asked whether fees for building permits pulled in 2035 would be based on 2005 rates; Elms replied the development agreement’s special condition requires developers to pay fees in effect at the time the building permit is applied for.
The planning commission recommended approval May 14, 2025. On City Council roll call, members voted to waive full reading and introduce Ordinance 1208 by title; the council recorded aye votes and the motion passed. Council instructed staff to process the ordinance for subsequent readings and recordation as required.
Ending: Staff noted no substantive changes to the plan or conditions are proposed: the extension preserves the map for 309 single‑family lots under the original terms and allows the developer to complete build‑out over the extended period. Council action was an introduction and first reading by title; final adoption follows the ordinance process.
