Legal counsel noted that courts have evaluated mixed public‑private transactions (the transcript referenced Hillsborough County/Tampa stadium precedent and industrial revenue bond law) and that language should track case law that allows limited private benefit so long as the public purpose is paramount and the private benefit is incidental. Several board members said they preferred including clear language to preserve incidental private uses; others cautioned that the board should avoid creating unintended loopholes.

The board did not vote on final text. Members asked staff to return refined language clarifying the standard for public purpose versus paramount public purpose and to show a drafting option that expressly allows incidental private benefit when the dominant use is public. The item was deferred for further analysis and redrafting.
