County attorney says lawsuit filed challenging Goldhawk zoning approval

A county attorney told the Planning and Zoning Commission that a lawsuit was filed Monday evening challenging the Goldhawk community zoning decision and naming Maricopa County, this board and each member individually.
“There was a lawsuit filed Monday evening. I don't know if you've heard about this, but it does name the county, this board, and each of the members individually,” the county attorney said. The attorney said the complaint alleges violations of open meeting laws and the zoning code and seeks declaratory relief and writs to address the alleged deficiencies.
The attorney described the filing as an early-stage complaint and said staff and counsel will provide updates as the matter proceeds. The attorney identified the matter as relating to Goldhawk and noted representation for the petitioners by Snell & Wilmer; the attorney said the clerk may contact board members about the fact they were named individually.
A separate staff comment noted that the Goldhawk zoning was approved by the board the previous day. No legal determination, hearing date or change to the approved zoning was announced during the meeting; the county attorney described the case as in initial stages and said the county will follow normal notification procedures.
