Lot 5 is 12 townhomes. Lot 4…is like 350 garden style apartments, like, 3 story apartments. And then Lot 6 is, I think, it's, like, a 70 unit podium building.” He said subdividing will allow some components to be sold to owner‑users rather than built speculatively.
A nearby property owner, Michael Todd, spoke during public comment to describe difficulties keeping his adjacent parcel (labeled Desert Star Theatrics) cleared of encampments and his unsuccessful sale negotiations with the applicant and others. Todd asked the commission to consider the frontage’s appearance and potential re‑use; staff said they would encourage coordination between the applicant and Todd.
Planning staff reported 137 mailed notices to owners within 400 feet and one phone inquiry. Staff recommended approval subject to seven conditions. Commissioner Pearson moved to grant preliminary and final subdivision approval for the 40 Ninth Street Galleria Subdivision at 4998 South Galleria Drive, and Commissioner Rogers seconded. The commission voted unanimously to approve the motion.
