During its June 4 meeting Morgan Township Zoning Commission conducted a first reading of proposed changes to Section 6.21 (fences) and discussed specific wording for above-ground and in-ground swimming pools.
Commission members reviewed a draft that would require the height from finished grade to the top edge of an above-ground pool to be a minimum of 48 inches and require a lockable ladder or other means to prevent uncontrolled access. The draft also includes a provision that lighting serving pools or supporting structures must be arranged to prevent light spill onto adjoining properties.
One member suggested clarifying that the measurement should be "above finished grade" to avoid attempts to place a pool in a slope and claim compliance based on panel height. Members discussed that the language aims to prevent circumvention of the rule by referring to panel height rather than finished grade.
The commission treated this as a first reading; staff will complete cross-references and renumbering and return a revised draft at a subsequent meeting.
