Park County commissioners approved the final plat for Charming Valley Simple Subdivision (SS 3-29), dividing about 34.61 acres into two lots for residential and agricultural use, after addressing a fencing question raised by the irrigation district.
Planning staff reported agency responses: Powell-Clarksburg Conservation District provided soil ratings; Garland Light and Power, Fire District 1, Northwest Rural Water District and other utilities confirmed service availability; and Park County Public Works said an existing 60-foot county road right-of-way serves the parcels but is not maintained by the county. The planning and zoning commission had earlier recommended approval with conditions. The applicant, Mark Rentschler, dedicated required easements and placed statutory notes on the plat, and staff confirmed final-plat specifications were met.
A remaining issue involved a small section of perimeter fence that would impede an irrigation-district easement; the irrigation district indicated it would remove any fence placed inside the easement. Commission discussion focused on whether to require a subdivision improvements agreement (SIA) to resolve the fence; staff and the board agreed the applicant's affidavit of compliance required by Wyoming statute 18-5-319 would address the fencing matter and that an SIA would only be required if additional fencing improvements were needed. The board approved the final plat with conditions but struck the staff-proposed condition requiring an SIA unless applicable.
One commissioner abstained from the vote due to prior contact about septic installation. The commission directed staff to finalize plat wording to reflect the agreed modifications and to record the plat once the affidavit and any other recording items are completed.
