City and BID continue technical and legal review of failed outdoor speaker system; sale or long-term replacement options under study

Staff and city officials updated the board on the downtown outdoor speaker system that the BID and city previously funded. The speakers are currently not functioning as intended. Staff said no formal contract was executed with the vendor (the work proceeded from a quote), which complicates legal remedies. City attorneys have reengaged and a local law firm with relevant experience is assisting.
IT staff are evaluating whether the physical speakers can be reused in a workable system or whether the failure is in the signal equipment. Staff reported the near-term legal posture: if IT determines a partial fix is possible for a modest sum, the city can make a precise demand to the supplier. If not, pursuing litigation could cost substantially more than the amount in dispute; officials signaled court expenses could approach or exceed potential recovery in federal litigation.
Staff also raised the option of selling the installed hardware to recoup value rather than pursue costly litigation that may yield little net recovery. The board and staff said the city has also received roughly $56,000 from insurance processes (reported as an amount accepted by City Council) and that funds could seed a long-term, properly contracted replacement tied to broader downtown utility and design work (for example, a future park building could house equipment).
No formal vote was taken. City staff and the BID will continue to pursue technical testing, attorney coordination and cost estimates, then present options back to the board.
