FLVS schedules closed litigation meeting in appeal against K12 Inc.; meeting to be transcribed

Florida Virtual School’s general counsel notified the board at its quarterly meeting that the trustees will hold a closed litigation meeting to discuss strategy and expenditures in the pending federal litigation Florida Virtual School v. K12 Inc.

The meeting notice, delivered on the record by FLVS general counsel, identified the matter as currently on appeal before the U.S. Court of Appeals for the Eleventh Circuit (case number 24‑10449) and the lower-court docket number 6:20‑cv‑02354. The litigation meeting is scheduled to occur upon or shortly after the start of the board’s next agenda-review workshop, currently set for 9:00 a.m. on Aug. 26, 2025.

“Florida Virtual School Board of Trustees litigation shade meeting is hereby requested to discuss litigation strategy and expenditures pursuant to section 286.0118 of the Florida statutes,” the general counsel said during the meeting.

The notice said the meeting will be limited to persons authorized under Florida’s closed‑meeting statute, that a certified court reporter will transcribe the session in accordance with section 286.011 (subsection 8), and that a copy of the transcript will be made part of the public record after the litigation concludes. The general counsel listed expected attendees, including board chair Linda Reiter, co‑chair Dr. Tony Arza, trustees, the president and CEO, FLVS deputy general counsel, in‑house counsel and two outside law firms (Luther Law Firm and Bishop, Paige & Mills). The notice estimated the closed session would last no more than 30 minutes.

Board chair Linda Reiter then returned the meeting to regular agenda business.

No public comment was taken on the litigation notice during the meeting’s open session.
