City Agrees to Quitclaim Overlap and Grant Drainage Easement for Redwood Apartments

The board approved execution of a quitclaim deed to resolve a deed overlap and granted a drainage easement to allow the Redwood Apartments project to complete drainage improvements that cross a small triangular parcel the city currently owns.
Planning Director Joanna Tennell said surveying for the Redwood Apartments development at the northwest corner of Upper Shelbyville Road and Eastview Drive revealed a deed overlap between the developer’s legal title and a small portion of city-owned land adjacent to a creek. Tennell said the city will quitclaim its interest in the overlapping strip so the parcel becomes wholly part of the developer’s property.
Tennell also said the developer will construct a two-stage drainage ditch and that part of that construction will occur on the city-owned land; the drainage easement grants the developer the right to construct and maintain that portion of the drainage system. Tennell told the board the developer has obtained approvals from the Indiana Department of Natural Resources for construction in a floodway and from the Johnson County Drainage Board and is finalizing city approvals.
Board members said the action “cleans up” an orphaned piece of property and shifts maintenance responsibility to the developer. The board approved the mayor signing the quitclaim deed, drainage easement and required sales disclosure form on behalf of the board.
